Internet data protection declaration

Fraunhofer-Gesellschaft zur Förderung der angewandten Forschung e.V. (Fraunhofer-Gesellschaft) takes the protection of your personal data very seriously. We process personal data which is collected during visits to our Platform in compliance with the applicable data protection law provisions. Your data will not be published by us nor passed on to unauthorised third parties in an unauthorised way. We give details below as to which data are collected during your visit to our Platform and exactly how they are used:

0. Definitions

This data protection declaration applies to the online services of Fraunhofer-Institut für Materialforschung und Logistik IML, Joseph-von-Fraunhofer-Straße 2-4, 44227 Dortmund as a legally non-independent institution of Fraunhofer Gesellschaft zur Förderung der angewandten Forschung e.V., Hansastraße 27 c, 80686 Munich (hereinafter referred to: “Fraunhofer IML”) on the second level domain warehouse-logistics below several top level domains, such as .com, .info or .it (e.g. www.warehouse-logistics.com, www.warehouse-logistics.info or www.warehouse-logistics.it).

The following definitions are used in this data protection declaration:

  • "Platform" is the online presence in accordance with section 0 of this data protection declaration.
  • "Logistics IT" is a software system for the support of logistical procedures and processes. This includes, for example, a WMS (Warehouse Management System), an TMS (Transport Management System), an FGS (Forklift Guidance System), an RPS (Resource Planning System) or a BI system (Business Intelligence System). A "Logistics IT provider" is a company or a person which/who offers Logistics IT to third parties.
  • A "Participant" is a Logistics IT provider which has concluded a contract regarding the participation in the Platform and is listed on it.
  • The »Logistics IT Database« is the database operated by Fraunhofer IML in which the Logistics IT providers and their Logistics IT are listed.
  • A "Logistics IT User" is a company or a person which/who uses or wants to use the Logistics IT.
  • A "User" is a company or a person which/who is not a Logistics IT provider but is registered on the Platform in order to gain access to the »Logistics IT Database«. Depending on whether the User is registered on the Platform for a charge or for free, the User has different services available. A User is typically a Logistics IT User which is registered on the Platform.
  • The »Logistik IT Online Selection« is the selection or filter function which can be used to access the »Logistics IT Database« on the Platform. The function is available to Users and Participants.
  • The »WMS Online Selection« is the selection or filter function which can be used to access the Warehouse Management Systems of the »Logistics IT Database« on the Platform. The function is available to Users and Participants.
  • A "Visitor" is a company or a person which/who visits the Platform without using specific services as a User or Participant. The Visitor has the possibility, for example, to read articles and contributions on the Platform.
  • Participants, Users and Visitors are referred to jointly as "guests".

1. Data collection and processing

a. when accessing from the internet

If you visit our Platform, our web servers temporarily store every access in a log file. The following data are collected and saved for up to eight days before being automatically deleted:

  • IP addresses of the requesting computer
  • date and time of the access
  • name and URL of the requested data
  • transmitted volume of data
  • notification of whether the request was successful
  • identification data of the browser and operating system used
  • websites from which the access is made
  • name of your internet access provider

The collection and processing of these data take place for the purpose of enabling use of the Platform (establishing the connection), to ensure system security and technical administration of the network infrastructure and to optimise internet services. The IP address will only be used in the case of attacks on the network infrastructure of Fraunhofer-Gesellschaft.

No personal profiles within the meaning of the TMG (Telemediengesetz [Telemedia Act]) are created. § 15 para. 3 TMG allows the use of profiles under a pseudonym provided the person concerned does not object. If we should make use of this possibility in our internet services, we will inform you of your right to object at the relevant time.

b. when registering on the Platform

As part of registration on our Platform, we collect the following compulsory data from you for access to »WMS Online Selection« (Express and Premium):

  • User name (only for Premium);
  • company;
  • title (Mr/Ms);
  • name (surname, first name);
  • address (street, house number, postcode, town, country);
  • role/ department;
  • e-mail address;
  • website;

We also collect information about the last time you logged on to our Platform and which language settings you use, without any additional actions from you.

In addition, you can voluntarily provide us with the following information:

  • title;
  • telephone/fax number;
  • sector of the company;

The following voluntary details can also be provided when registering for Premium Access and reference projects selection:

  • website;
  • VAT no.;
  • internal order number;

When registering a request for information (WMS reference projects), we additionally collect the following compulsory details:

  • title(Mr/Ms);
  • name (surname, first name);
  • country;
  • e-mail address;

and the following voluntary details:

  • company;
  • title;
  • address (street, house number, postcode, town);
  • role/ department;
  • contact information (telephone/ fax number);
  • website;
  • sector of the company;

We collect the above data in order to have information about who our contracting partner is and in order to establish, define the contents, execute and change the contractual terms with you about the use of our Platform and the services offered on it. The data are also required to check the data provided for plausibility and capacity to contract of the contracting partner and, if required, to make contact with you in case we have questions.

In addition, the following parts of contact data given for Express Access will be summarised in a project overview every quarter as a pdf file (company; surname, first name; address; role/ department; sector; e-mail address; where applicable telephone number) and are listed in the content management system of our Platform for each Participant and available as a CSV file (company; title; name; address; role/ department; e-mail address; telephone/ fax number; sector of the company; time of last login; language).

In addition, in the case of »WMS Online Selection« (Express), the data will be anonymised used for statistical evaluation.

No personal data will be processed in excess of the above cases, unless you expressly give consent to further processing.

Any use of your personal data will only be for the stated purposes and to the extent required to achieve those purposes.

2. Passing on of personal data

If you register via the »WMS Online Selection« (Express), your contact data (company; title (Mr/Ms); name (surname, first name); address (street, house number, postcode, town, country); role/ department; e-mail address) will be transmitted to the Participants for the purpose of making contact.

You are entitled to withdraw your consent to the transmission of your data for the purpose of advertising to our Participants at any time. In order to do so, please use our contact address under section 7.

Any other transmission of personal data to state institutions and authorities will only take place in the context of compulsory national legal regulations or if there is a requirement to pass on the data for civil or criminal prosecution in the event of attacks on our network infrastructure.

We will not sell or otherwise pass on your data to third parties without your consent.

3. Consent for further use

The use of specific services on our Platform, such as newsletters or forums, requires advance registration and more extensive processing of personal data, for example, long-term storage of e-mail addresses, User logins and passwords. These data will only be used if you provide them to us and have consented to their use in advance.

Newsletters and press distribution lists

In order to register for the newsletter service of Fraunhofer IML, we need at least your e-mail address which we will use to send you the newsletter. Other details are voluntary and will be used in order to contact you personally and to be able to clarify questions regarding your e-mail address. We need your address data in order to send you items by post. In the case of press distribution lists, we need details of press organisations for which your work, so that we know that a press organisation is actually being supplied.

We generally use the double opt-in procedure for sending newsletters. This means that we will not send you the newsletter until you have confirmed your registration by clicking on a link we have sent you in an e-mail using the e-mail address you have provided during registration. This is intended to ensure that only you can register yourself for the newsletter service as the owner of the e-mail address given. Your confirmation must take place soon after we send the e-mail because otherwise your registration and e-mail address will be deleted from our database. Until we have received your confirmation, our newsletter service will not accept any further registrations using this e-mail address.

You can unsubscribe from one of our newsletters at any time. In order to do so, you can either send us an e-mail, or click on a cancellation link at the end of the newsletter.

Guest books and forums

In order to register for a Fraunhofer IML internet forum, we need at least a user-login, a password and your e-mail address. For your protection, registration for one of these services can only take place analogously to the registration for a newsletter service once you have confirmed your registration through an e-mail we have sent you and the link which is included.

You can terminate these services at any time by sending us an e-mail via the relevant website for the service.

Guest books and forums are generally not subject to any control by Fraunhofer IML in terms of the contents. At the same time, we reserve the right to delete contributions at our discretion, and to exclude you from further use, in particular if contributions meet the criteria for criminally-related circumstances or are inconsistent with the objectives of the Fraunhofer-Gesellschaft.

Orders

If you order information materials, we will use the address data you provided in order to process the order. We will not pass the data on to third parties.

Web analysis

a. WiredMinds

Fraunhofer IML uses a service from WiredMinds AG for web analysis of its Platform. Using WiredMinds AG technologies, data are collected and stored on the Platform for marketing and optimisation purposes. User profiles are created from these data using pseudonyms. Cookies can be used for this purpose. Cookies are small text files which are stored locally in the cache of the internet browser of the website Visitor. The cookies enable the internet browser to be recognised. The data collected using the WiredMinds technologies are not used to identify the Visitor to this website personally without the specifically granted consent of the person concerned and they are not combined with personal data about the carrier of the pseudonym. Consent for collection and storage of data can be withdrawn at any time with future effect. To withdraw consent, please follow this Link.

b. Matomo

On our website, we use the open source service Matomo by InnoCraft Ltd in New Zealand to analyse the activities of our website users and to optimise our website and its content based on this analysis. In the process, we do not receive any information, which identifies our users.

In context with using the Matomo service, we use cookies, which enable the service to analyse the activities of our website users. The cookie contains information, including personal information, which characterises your visit on our website. Under a pseudonym, Matomo creates your user profile for analytical purposes. Since we host the Matomo services on our own server, the analysis does not require the processing of data by third parties.

Without your specific permission, we do not use the collected data to identify you personally and will not combine the data with personal data about you under a pseudonym associated with you.

To the extent that we collect IP addresses in our analysis, these addresses are stripped of their last control number block upon collection to anonymise the IP addresses instantly. We delete further personal data stored in the cookie after 365 days.

We process the statistical data based on our legitimate interests in the optimisation of our online offerings and our web presence according to Article 6 para.1 lit. f GDPR.

Matomo

4. Security

Fraunhofer IML uses technical and organisational security measures in order to protect your personal data managed by us against accidental or intentional manipulations, loss, damage or against access by unauthorised persons. Our security measures are continually being improved in line with technological developments.

5. Cookies

We generally do not use cookies on the Platform. Cookies are only used exceptionally in order to file data for technical session control in your browser's cache. These data are deleted when you close your browser.

If, exceptionally, we also want to store personal data in a cookie, such as a user-login, we will notify you specifically about this.

You can, of course, also view our Platform without cookies. However, most browsers accept cookies automatically. You can prevent cookies from being stored by changing this in your browser settings. If you do not accept cookies, this could lead to restrictions in the functions of our services.

6. Links to websites of other providers

Our Platform may contain links to websites of other providers. Please note that this data protection declaration applies exclusively to the Fraunhofer IML Platform. We have no influence and do not check whether other providers comply with the applicable data protection provisions.

7. Right to information, correction, deletion and contact data

You have a right to information concerning the personal data about you which is stored and also a right to correct incorrect data, to block and to delete data.

8. Inclusion, validity and topicality of the data protection declaration

The data protection declaration is currently valid and dated as at 27/11/2020.

It may be necessary to modify this data protection declaration as a result of further developments of our Platform or of implementing new technologies. Fraunhofer-Gesellschaft reserves the right to modify the data protection declaration at any time with future effect.
